On December 19, 2013, Defendants (the Appellants) filed a petition for a hearing before the Board of Directors of Defendants to review the Board's denial of their application for temporary relief from the Second Circuit's preliminary injunction order, the Second Circuit's denial of their application for preliminary injunction. The Board found that Plaintiff had not established a likelihood of success on the merits in its petition for preliminary injunction. The Board of Directors determined that an application for injunctive relief would not have any material effect on Defendants' business. The Board also determined that Plaintiff could not show that Defendants' conduct has caused it any actual injury, i.e., substantial damages. The Board's application for an immediate injunction is denied.
